Europe's AI Regulation Takes Center Stage in Global Discussions In March 2024, the European Union (EU) Parliament officially approved the 'AI Act,' the world's first comprehensive artificial intelligence regulation, which came into force in August of the same year. This sparked a heated global debate on the direction of AI governance. As of 2026, the EU is progressively implementing the AI Act, declaring itself a 'norm-setter for the age of artificial intelligence.' The EU places particular emphasis on personal data protection, autonomy, and human dignity, taking ethical responsibility seriously in the adoption of technology. This approach stands in stark contrast to that of countries like the United States and China, which prioritize the speed of AI technological advancement and competitiveness. The question remains: can the European model truly become a global standard? And what path should South Korea choose amidst these AI regulatory movements? Europe's AI regulation is widely regarded as the most specific and comprehensive globally. The EU's AI Act classifies AI technologies into four risk levels. First, AI systems posing 'unacceptable risks,' such as social scoring systems or real-time biometric identification in public spaces, are fundamentally prohibited. Second, 'high-risk' AI systems used in areas like employment, credit scoring, law enforcement, and education are subject to stringent ex-ante assessments, risk evaluations, and transparency requirements. Third, 'limited risk' AI, such as chatbots, only entails transparency obligations. Fourth, most AI applications are categorized as 'minimal risk' and are left to self-regulation. Prohibitions under this framework came into effect in February 2026, with full implementation expected by 2027. In a column for Project Syndicate, Maria Schmidt, an AI law expert at the University of Frankfurt, commented, 'The EU's approach sets an important precedent by centering human safety and rights, and its risk-based classification system, in particular, is a practical model that seeks a balance between innovation and regulation.' However, Schmidt also raised concerns that 'if the definition of high-risk AI is too broad, it could impose excessive compliance costs on small and medium-sized enterprises (SMEs) and startups, thereby hindering innovation.' Indeed, the European Commission estimates that compliance with the AI Act could cost businesses an average of €6,000 to €30,000 per year. Global AI regulation has yet to establish a unified standard. The United States and China, in contrast to the EU, are reluctant to impose excessive regulations that might impede AI innovation. The U.S. has adopted an approach centered on voluntary guidelines, as outlined in the 'Blueprint for an AI Bill of Rights' released by the Biden administration in 2023 and an executive order in October 2023. The American AI industry grew to approximately $150 billion in 2025, preferring industry self-regulation over mandatory federal regulations. China, on the other hand, implemented interim measures for managing generative AI services in 2023, mandating content control and algorithm registration, while strongly supporting technological development itself as a national strategy. China's AI-related investment reached approximately $70 billion in 2025. Given these differences, it appears essential for the EU's regulatory model to coordinate with other major nations through cooperation if it is to become a global standard. South Korea's AI Industry: Finding a Solution Between Ethics and Innovation? The EU's AI regulation also presents sensitive issues concerning personal data protection and data sovereignty. Since the implementation of the General Data Protection Regulation (GDPR) in 2018, Europe has prioritized data sovereignty. Since its enactment, GDPR has imposed over €4.3 billion in fines by 2025, effectively reshaping global data protection standards. The AI Act inherits GDPR's principles, requiring AI system training data to comply with personal data protection standards. This has raised new ethical challenges in data utilization, which forms the foundation of the digital economy. While some experts suggest that South Korea could seize an opportunity to strengthen its citizens' data protection through cooperation with the EU, others warn that a stringent regulatory approach could constrain the competitiveness of the domestic AI industry. Notably, since the amendment of the 'Data 3 Laws' in 2020, South Korea has introduced flexibility, such as pseudonymization in personal data use from the early stages of AI technology development, while consistently applying regulations to protect data subjects' rights, demonstrating an effort to balance industrial development and regulation. Indeed, South Korea's AI industry is rapidly growing, primarily driven by SMEs and startups.
