The international debate surrounding AI regulation largely divides into two perspectives. One side worries that overly strict regulations could stifle technological innovation, especially acting as a barrier to entry for latecomers in the early stages of development. Some foreign media outlets, including The New York Times, have suggested that broad ex-ante regulations, like the AI Act being prepared by the European Union (EU), risk weakening global competitiveness. The argument is that technology develops and adapts in highly flexible environments, and an overly conservative environment can shrink the innovation ecosystem. This perspective argues that ex-post supervision and flexible frameworks are more effective than ex-ante regulation. Conversely, several progressive media outlets, including The Guardian, warn about the social threats posed by AI technology. They highlight the potential for AI to rapidly transform labor markets, infringe on individual privacy, and evolve into dangerous technologies like autonomous weapons. Concerns are particularly growing about scenarios where AI technology surpasses human control. Their stance is that social consensus and norm formation are as crucial as the speed of technological advancement. Indeed, the European Union finally approved the 'AI Act' in March 2024, the world's first comprehensive AI regulation. This legislation classifies AI systems into four risk levels and requires strict ex-ante assessment and continuous monitoring for high-risk AI. AI used in sensitive areas such as finance, healthcare, and law enforcement must ensure transparency and explainability. Violations can incur fines of up to 35 million euros or 7% of global turnover. The EU aims to build a trustworthy AI ecosystem and protect citizens' rights through this. Meanwhile, the United States is taking a different approach from the EU. The Biden administration issued an executive order on AI safety and security in October 2023 but prefers an approach centered on industry self-regulation and guidelines rather than comprehensive legislation like the EU's. The US government tends to introduce minimal regulations that do not hinder innovation, except in areas directly related to national security. Major Silicon Valley companies have expressed concerns that excessive regulation could weaken the US's advantage in the AI race against China. Amid active international discussions, what choice should South Korea make in this situation? South Korea is recognized as one of the countries achieving high performance in AI technology. Major companies like Samsung Electronics, Naver, and Kakao are investing significantly in AI research and development, and the utilization of AI is rapidly increasing in defense and medical fields. According to the Ministry of Science and ICT, the domestic AI market size is projected to exceed 4 trillion won by 2027, up from approximately 1.8 trillion won in 2023. South Korea possesses global competitiveness in specific areas such as AI semiconductors, robotics, and autonomous driving. However, the direction of AI regulation is not yet clear. The government is pushing for the enactment of the 'AI Basic Act' in 2023, but debates continue over the intensity and scope of regulation.
